1. Agreement to these terms

By using this website or placing an order, you agree to these Terms of Service, together with our Privacy Policy, Shipping Policy, Refund & Returns Policy and Cookie Policy. If you do not agree, please do not use the site.

In these terms, “we”, “us” and “our” mean Hollis & Hem LLC, trading as Hollis & Hem, of 412 Foundry Lane, Suite 210, Portland, OR 97209; “you” means the person using the site or placing the order.

2. Eligibility

You must be at least 18 years old, or the age of majority in your state, and able to enter into a binding contract. You must provide a delivery address within the United States. Orders may be placed for personal use; we do not knowingly sell to resellers through this site.

3. Demonstration store notice

This website is currently a demonstration build. The checkout cannot take payment: it collects a shipping address and a payment method, then always returns a declined result. No card number, expiry date or security code is requested anywhere, no order can be completed, and no contract of sale can be formed through this site in its present state.

Sections 4 to 7 describe how orders would work on a live version of this store and are included so the terms are complete.

4. Orders and acceptance

Placing an order is an offer to buy, not a completed contract. We accept your offer when we send a shipping confirmation email. Until then, we may decline or cancel an order — for example if an item is out of stock, if there is a pricing error, if we cannot verify the payment, or if the order appears fraudulent.

If we cancel an order after taking payment, we refund in full, to the original payment method, and we email you to explain why.

We may limit quantities per customer or per order where stock is short. Any limit is shown on the product page before you add the item to your cart.

5. Pricing and errors

All prices are in US dollars and exclude sales tax, which is calculated at checkout based on your delivery address. Shipping is shown as a separate line in the cart and at checkout. The total you see before you pay is the total you pay — nothing is added afterward.

We try hard to price accurately. If an item is listed at an obviously incorrect price, we may cancel any affected order and refund you in full. We will not charge you more than the price shown when you ordered, and we will not process an order at a mistaken price and then invoice you for the difference.

Prices can change at any time, but a change never affects an order already placed.

6. Payment

On a live store we would accept credit and debit cards, PayPal, Apple Pay and Google Pay. Card details would be collected and processed by a PCI-compliant payment provider over an encrypted connection; we would not receive or store full card numbers.

You confirm that you are authorized to use the payment method you select. We charge at the point of authorization for the full order total shown at checkout. We do not enrol you in any subscription, membership, auto-reorder or recurring charge — this store sells one-time purchases only.

7. Shipping and returns

Shipping rates, delivery estimates and the free shipping threshold are set out in the Shipping Policy. Return eligibility, the 30-day window and refund timings are set out in the Refund & Returns Policy. Both are incorporated into these terms.

Risk of loss passes to you on delivery by the carrier. Our approach to parcels that go missing in transit is described in the Shipping Policy: in short, we trace them, and we reship or refund.

8. Product descriptions and colors

We describe our products as accurately as we can, including fiber content, measurements and fit. Even so, colors can look different from one screen to another, and a garment's measurements are subject to a small manufacturing tolerance, typically half an inch. A color that looks different in person is a valid reason for a return under the Refund & Returns Policy.

Product photography on this demonstration build is licensed stock imagery, not photographs of the items described. On a live store, every image would show the item being sold.

9. Acceptable use

You agree not to use this site to: break the law; place fraudulent orders; scrape, mirror or republish our catalog; probe or interfere with the site's security; upload malicious code; or impersonate us or anyone else. We may suspend access where we reasonably believe one of these is happening.

10. Intellectual property

The Hollis & Hem name, logo, garment designs, product descriptions, page copy and site design are owned by us or licensed to us, and are protected by copyright, trademark and other laws. You may view, download and print pages for your own personal, non-commercial use. You may not reproduce our copy or imagery on another commercial site.

Stock photography used on this site is licensed under the terms of its source and remains the property of its respective photographers. Credits are recorded in the project's image credits file.

11. Content you send us

If you send us feedback, suggestions, photographs or reviews, you give us a non-exclusive, royalty-free license to use them in connection with the store, and you confirm you have the right to do so. We will not attach your full name to a review without asking you first. You keep ownership of anything you send.

12. Third-party links

Our site links to social media profiles and to our service providers. We do not control those sites and are not responsible for their content or their privacy practices. Their terms apply once you leave our site.

13. Disclaimer of warranties

The site is provided "as is" and "as available". To the fullest extent permitted by law, we disclaim implied warranties of merchantability, fitness for a particular purpose and non-infringement in relation to the website. We do not warrant that the site will be uninterrupted or error-free.

Nothing in this section limits any warranty or right you have in relation to goods you purchase under state or federal consumer law, including the implied warranty of merchantability where it applies. Some states do not allow the exclusion of implied warranties, so parts of this section may not apply to you.

14. Limitation of liability

To the fullest extent permitted by law, our total liability to you arising out of or relating to your use of the site or any order is limited to the amount you paid for the order that gave rise to the claim.

We are not liable for indirect, incidental, special, consequential or punitive damages, or for lost profits or lost data. Some states do not allow these limitations, so they may not apply to you. Nothing here excludes liability for fraud, for death or personal injury caused by negligence, or for anything else that cannot lawfully be excluded.

15. Indemnity

You agree to indemnify us against claims, losses and reasonable legal costs arising from your breach of these terms or your misuse of the site. This does not apply to claims arising from our own acts or omissions.

16. Governing law and disputes

These terms are governed by the laws of the State of Oregon, without regard to its conflict of law rules. Any dispute will be brought in the state or federal courts located in Oregon, and both parties consent to that jurisdiction.

Demo value: Hollis & Hem LLC is a fictional company and Oregon is a sample state of incorporation. Set your own before these terms bind anyone.

Before filing anything, please contact us at support@hollisandhem.com. Almost everything is resolved in one email. Nothing in this section prevents either party from bringing a claim in small claims court, and nothing prevents you from contacting your state attorney general or a consumer protection agency.

17. Changes to these terms

We may update these terms. The effective date at the top of this page shows the current version, and the version in force when you placed an order governs that order. Material changes are announced on this page before they take effect.

If any provision of these terms is held unenforceable, the rest remains in force. Our failure to enforce a provision is not a waiver of it.
